Please read these General Sales Conditions carefully. These general sales conditions are those of the company, Les Boucheries Nivernaises. The company, Les Boucheries Nivernaises, may update these General Sales Conditions at any time. The General Sales Conditions in effect at the time of the sales contract conclusion are those that apply to you. The act of purchase implies a pure and simple acceptance without reservations of said general sales conditions.

1. Seller Identification

The present General Terms and Conditions of Sale are those of Boucheries Nivernaises, a simplified joint-stock company with a capital of €30,000, registered with the Paris RCS under number 389 626 938, whose head office is located at 99 rue du Faubourg Saint-Honoré 75008 PARIS. 2. Scope and Acceptance of the General Terms and Conditions of Sale

The purchase of products offered on the website is subject to these general terms and conditions of sale. The products offered for purchase on the site are exclusively intended for sale to end consumers, both individuals and corporations, excluding all resellers or intermediaries acting on behalf of resellers. Therefore, when placing an order, the customer affirms that they are acting as an end consumer and do not intend to resell the products offered by Boucheries Nivernaises for commercial purposes. Furthermore, they certify that they have the legal capacity to undertake the commitments set forth herein.

3. Order Procedures

The Site allows you to order a selection of Products offered by Boucheries Nivernaises on its website. The Site does not allow for special orders, particularly those involving the creation of a Product that no longer exists or is not part of the offer, or the adaptation or customization of a Product from the proposals of Boucheries Nivernaises and its manufacture by Boucheries Nivernaises.

4. Product Availability

Our product offers and prices are valid as long as they are visible on the site, subject to stock availability. Errors or changes may exceptionally occur, especially in the case of simultaneous orders of the same product by multiple customers.

In the event of a product unavailability after placing your order, we will inform you via email as soon as possible, offering you either to order another product featured on the site as a replacement or to cancel your order and proceed with its refund. The company Boucheries Nivernaises cannot be held responsible in the event of stock shortages or unavailability of products for orders it has not yet accepted. The company Boucheries Nivernaises reserves the right to change, at any time and without notice, the products offered on the site depending on the availability of its suppliers. Finally, to ensure better service quality and availability of our products for all site customers, Boucheries Nivernaises reserves the right to limit the quantity of products that a customer can purchase. This is in accordance with applicable provisions, particularly those of Article L121-11 of the Consumer Code.

5. Ordering Procedure

To make a purchase within the e-store, it is not necessary to create an account. From the homepage or product display page, the user clicks on any product of interest to view its details. They can then add recommended products and select the desired quantity. The user can either add their selection

to the cart or proceed directly to purchase. If the user chooses to click on “buy now”, the page for entering personal information to place the order appears and must be completed (with some fields being optional). They are then directed to a secure bank information entry page where they can also specify if they wish to enter a different billing address. Following their order, the user receives a confirmation email and/or SMS.

If he has chosen to add to the cart, a button appears allowing him to view the contents of the cart and place an order; he then arrives on the same page as if he had clicked on “buy now”. In the context of making a purchase, the user has the option to provide additional information such as “address supplement”. The user therefore commits not to publish comments that glorify crimes against humanity, incite acts of terrorism or their glorification, provoke racial hatred, hatred towards individuals based on their sex, sexual orientation or identity, or disability, incite violence and specifically violence against women, infringe human dignity, as well as child pornography or any other reprehensible content. In the same way, the user commits not to publish comments whose content would violate any intellectual property rights of a third party, or have promotional and/or commercial purposes. Boucheries Nivernaises reserves the right to take legal action against anyone who does not respect these conditions.

6. Delivery Procedure

Zone 1 – Paris and the Île-de-France region: Orders over €80 qualify for free delivery. However, orders under €80 incur a delivery charge of €25.

Zone 2 – The Province (all regions except Paris and Île-de-France): For orders over €80, delivery charges apply based on the weight of the package:

– From 0 to 5kg = €20

– Over 5kg up to 10kg = €25

– Over 10kg up to 15kg = €30

– Over 15kg up to 20kg = €35

– Over 20kg = €45

For orders less than €80, an additional fee of €25 will be added to the delivery charges indicated above.

We do not offer delivery to Corsica.

7. Price - Accepted Payment Methods

7.1. Price

The prices of the Products are indicated in Euros, inclusive of all taxes.

Products are billed based on the rates displayed on the Site at the time of placing your order, subject to the availability of the Products ordered at that moment. All orders are payable in Euros and must be settled immediately at the time of placing your order.

7.2. Accepted Payment Methods

The accepted credit and debit cards are: Visa®, MasterCard®, American Express®. The dispatch of your order will only take place after verifying your payment method and receiving debit authorization from your card. The charge to your account will occur at the time of your order’s delivery.

8. Right of Withdrawal

For any order of perishable products, in accordance with Article L 121-21-8 4° of the Consumer Code, the right of withdrawal cannot be exercised. This applies to food products including meat, charcuterie, dairy products, and eggs which, due to their perishable nature, are excluded from the right of withdrawal.

9. Limitation of Liability

Under no circumstances can the liability of Boucheries Nivernaises be engaged for any damage that does not result from a failure by Boucheries Nivernaises to fulfill one of its obligations.

10. Applicable Law - Disputes

These General Sales Conditions are governed and interpreted in accordance with French law. However, pursuant to Regulation EC 593/2008 of June 17, 2008, these general sales conditions do not prevent the application of a more favorable provision to the customer, which cannot be waived by agreement, under the law of the country where the customer has his usual residence. In case of dispute related to the application and/or interpretation of these General Sales Conditions, the client has the option to resort to a conventional mediation procedure or any other alternative dispute resolution method. In accordance with Ordinance No. 2015-1033 of August 20, 2015, and implementing Decree No. 2015-1382 of October 30, 2015, any consumer-related dispute or litigation, subject to Article L612-2 of the Consumer Code, can be amicably resolved through mediation at the CMAP – Paris Mediation and Arbitration Center. To submit a dispute to the mediator, the client can (i) fill out the form on the CMAP website: www.cmap.fr under the tab “you are: a consumer”, (ii) send their request by regular or registered mail to CMAP Consumer Mediation, 39 avenue Franklin D. Roosevelt, 75008 PARIS, or (iii) send an email to consommation@cmap.fr.

Regardless of the method used to contact CMAP, the client’s request must contain the following elements for prompt processing: postal, email, and telephone contact details, as well as the full names and addresses of Boucheries Nivernaises company, a brief statement of facts, and proof of prior steps taken with Boucheries Nivernaises. Notwithstanding the foregoing, in case of dispute, and in accordance with Regulation No. 1215/2012 of December 12, 2012: – the client may choose to bring proceedings either in their home courts or in French courts. – Boucheries Nivernaises Company may take legal action at the court of the customer’s domicile. In case of a dispute related to the execution of an order, if you are an end consumer individual, you have the option to resort to a free conventional mediation procedure or any other alternative dispute resolution method. If you wish, you can use the online dispute resolution service offered by the European Commission in accordance with Article 14 of Regulation (EU) No 524/2013. This platform can be accessed at the following address: https://webgate.ec.europa.eu/odr/. Mediation is an alternative mechanism that does not constitute a prerequisite for taking legal action.
